SUBDIVISION & SANITATION REVIEW
In Montana, there are two laws that regulate subdivision activity - The Montana Subdivision and Platting Act (MSPA) and The Montana Sanitation in Subdivisions Act (MSSA) Both Acts (MSPA and MSSA) have their own list of exemption circumstances where the requirements of the Acts don’t apply, and in some cases neither Act may apply. Even in cases where neither Act applies, wastewater treatment systems within Gallatin County boundaries are regulated under the Gallatin City-County Regulations for Wastewater Treatment Systems.
The two Acts define the term “subdivision” differently. 
Gallatin City-County Health Department, Environmental Health Services staff review subdivision proposals for water supply provisions, stormwater drainage provisions, solid waste provisions and wastewater treatment provisions under the Montana Sanitation in Subdivisions Act. In addition to state regulation requirements, subdivision proposals must meet local wastewater treatment regulations, which may be more stringent than minimum state standards.
