The Court can ONLY enforce a Subpoena, and compel the person to attend court WHEN the subpoena is properly served AND either the party files a timely return of service with the clerk of court.
Timely filing the proof of service requires that it be filed with the clerk AT LEAST twenty-four hours prior to the court date and time and notice has been given to the opposing party.
Parties subpoenaing witnesses have a duty to send a copy of this return of service of subpoena to the opposing party.
